They Had a Coup d'etat and We Weren't Invited...Now It's Our Turn

The people aren’t rising up because they are HAPPY with their government. They elected George Bush and then they reelected him by an even larger margin.
Despite what I see all over this web page, Americans aren’t stupid, they are reasonably well informed, and they have a healthy level of cynicism about politicians. They understand what their government is doing, and they approve. You can whine about the so-called gulag, but the vast majority of Americans have NO PROBLEM with what happens at Guantanamo or elsewhere.
Quit whining that someone has stolen your government or swindled us. No such thing has happened. The government is providing EXACTLY WHAT AMERICANS WANT. Quit screeching and start doing some persuading. Resistance is not the answer. There will be no coup, no revolution. Americans are OVERWHELMINGLY HAPPY with their government, and tens of thousands more who love America come every year. There is no possibility of a revolution.
If you want to change the way things are done, you need to start CONVINCING PEOPLE to do something else. I don’t see any evidence of that happening on this web page. You’re doomed to failure if you don’t change your tactics.

To previous commenter...I agree with you and look forward to seeing some suggestions from YOU about how we can bring about change. Below is something I wrote recently that expresses a view similar to yours.
LIFE IN THE UNITED STATES OF APATHY
Grandpa has to go to Canada for his medicine. Oh well, the long bus ride will do him good.
Grandma was mugged in the grocery store parking lot last week. It’s all her fault. I told her to sign up for that karate class. Next time she’ll listen to me.
The neighbors have no medical insurance. That’s their problem.
Suzy was bullied in school yesterday. So what’s the big deal. It happens to everybody.
The government says that there will be no Social Security soon. I don’t care. I will be dead before the fund runs out. Let them spend all of the money on bombs.
The grocery store has no affordable natural vegetables. It’s that GMO thing. Hey, if you don’t like it, move someplace else.
The fish are contaminated with PCB’s. We can eat meat instead. Getting Mad Cow disease makes you sick and then you die. Everybody’s gotta die sometime.
They say that asthma is on the increase because of pollution. What’s the problem? Everybody can get an inhaler.
The family down the street just had their water shut off because they couldn’t pay their water bill. It costs a lot of money to fix the water and then put it in pipes, so nobody should get it for free. In the old days everybody had a rain barrel.
My nephew is complaining because he was just told by his boss that he had to work “off the clock” for no pay on weekends. I told my nephew to stop being such a whiner. Corporations are good. They are what made America what it is today. We should all be patriotic and help the corporations. They are the backbone of our country.
They say that we are killing innocent people in Iraq. Hey, nobody’s perfect. Be glad that you live in a country that is willing to go all around the world to show everybody who’s boss. Killing people ain’t easy and besides that it costs a lot of money. They should be thanking us. If you don’t like it here, find someplace else to live.
Now I’m going to take a nap. Wake me up when it’s time to watch Nascar. Then I’m going out for a 6-pack and a couple more of those yellow magnet ribbons for my car. I am happy to live in a country as wonderful as this.

Bush should be impeached, not because he is the first President to do what he has done, but because we want our government to work for us NOW.
Yes, and I would also like to hear what the first commenter is doing to convince the public to change their ways.

Rosemarie is right. There was a coup that no one told us about and it has been going on for a long time. It is obvious the two party system is one and the media complicit in the coup. Impeachment is not enough...there is criminal activity going on.. If we continue to allow this, we are complicit. First, they went for the terrorist, then the dissenters...etc. There is a pattern going on here.
Americans are awake but don’t know what to do. John Conyers has a least opened the door for people to have a place to speak out. Sending contributions to Conyers is a start...rewarding members of Congress would get others attention...and more may begin to start demanding accountability. We have to support those that are not intimidated. It is our only chance to stand up to those who have circumvented the rule of law for their devious purposes whatever they are.
We also should reward media that speaks truth to power...we need them for a peaceful change or we will all be in trouble. Let’s start with Conyers and keep a running log of the truth seekers that we can support. Mary

Join or create your own Common Law Movement. The coop-de-tat has taken place slowly over time since the Civil War, but they struck a major victory when the Uniform Commercial Code (U.C.C.) supplanted Constitutional Common Law, introducing Admiralty Law into the intra-national setting. This happened in 1938 and is completely outside Constitutional parameters. That information is part of history and can be found in any library or on the net. (Put “U.C.C. 1-207 Howard Freeman in your search engine.) Most Americans don’t even know how what Common Law is anymore, and that it was taken away from us. We must push for the overthrow of the U.C.C and the return to Common Law. Please study what Common Law is supposed to be and compare it to how the laws affect us today. Under Common Law There is no crime with out a victim. That is the biggest visible difference, but it goes much deeper.

Impeachment? For starting a war, based on a lie, for lying to congress, the American people and the world at large? For ignoring the true dangers leading up to 9/11, then promoting or rewarding every single person involved in the failures of intel and analysis? For relying on a sycophantic soviet historian as a national security advisor whose best talents reside on a keyboard? For destroying our constitutional protections and selecting Ashcroft and “Mr. Torture” Gonzales as the protectors of our rights?Impeachment? you bet!

True ... and rightly sparked passion and anger convince. Emerson put it this way:

Considering what Rosemarie is writing about, I’d say her words would ring false minus the fiery indignation.

You wanted to know what I suggest:
(1) Don’t rant. The only people who will listen are the conspiracy nuts. See, for example, commenter #6 above, Sunny Reid, a very odd person. The article he cites is a lovely mix of apocalyptic Christian fundamentalism, anti-Semitic conspiracy theory (the Rothchilds did us in) and bad law. Those of us old enough to have litigated non-UCC cases know what a good thing the UCC is compared to what came before.
(2) Talk calmly, rationally. Persuade. Don’t yell. Don’t look for conspiracies. As I said before, there was no coup. The government is providing exactly what America wants. Your job is to convince them to want something else.
(3) Most important, DO SOMETHING. I defend poor people from predators and con artists: used car dealers, vinyl siding vendors, credit companies, predatory mortgage companies, negligent section 8 landlrds, etc. What do you do, besides write angry rants? You should pick a single, limited cause and do something.

To commenter # 12… What you call ranting, others might call a passionate plea for change. There are plenty of excellent authors out there who do write in a style that might appeal to you more. I think of William Blum, Mickey Z, Ward Churchill, and many others. Just check the writers on this site for their other books and articles. You say, “...talk calmly...”. That would be counterproductive. It would trivialize the slaughter that has been taking place in our names. You also say, “...do something...” I agree, actions are more important that words. I suggest that you Google, “Rosemarie Jackowski”. You will see that I have been very busy. If you only knew.......

As I said Most Americans don’t even know what Common Law is anymore, but it is exactly what T. Jefferson prescribed for this country. Having studied it, and understanding it to some extent, I can tell you that I much prefer Common Law to the UCC. Since you stated that you have litigated in Common Law cases, you may be in the law profession. That being the case, I recommend you study the different systems of law, know how they were developed, why they were implemented, and how they are being employed. Your comments indicate you haven’t done this. That puts you in the same boat as the high priced CEO who knows nothing about cars and finds himself stuck on a desert highway, out of phone a service area, not knowing how to reconnect a battery cable, and dying of thirst. Having several lawyers in the family, and having pumped their brains for information from time to time, it is my understanding that a lawyer doesn’t learn so much what law is or where it came from, but rather how to manipulate the system of law they are working under. I can imagine that litigating a Common Law case in a UCC jurisdiction is very much like looking for a brain in a 1960’s automobile. It doesn’t have a brain. You have to be smarter than the car. You have to know the inner workings of the engine, how it works and why it works. You must know the system of law, how it works, and why it works. The UCC is a fraudulent combination of Equity Law, which is civil Law and has no criminal penalties, and Admiralty Law, which has criminal penalties but is juryless. Since the Constitution stipulates a requirement for juries, how can the UCC be constitutional? Common Law is what made this country so great to start with, and Common Law can return us to an honest government, administered by statesman instead of self-serving, power-hungry, politicians who are more criminal than most who are incarcerated under their unconstitutional law. And yes, it will take a LOT of work, but it is much preferable to our current situation. I believe in peaceful reform if at all possible. And I will work to that end in all my endeavors. And I will work in openness and honesty. I suggest you read the biography of John Adams by David McCullough. Adams was an honest, moral God-fearing statesman who abhorred party politics. He devoted his entire life to American independence and stability. The comment he made in a letter to Abigail, when he moved into the White House, (as it would come to be known years after his residence, there) was this, “I pray to heaven to bestow the best of blessings on this house and all that shall hereafter inhabit. Whoever said or says there is no conspiracy either has their head buried in the sand, or is part of it and trying to convince others of the lie. It is no longer a theory. It is an established fact, and has been for some time. If the government is doing exactly what people want, why are people mad? Why don’t televised debates include ALL parties instead of only two? If you litigated Common Law before the UCC, you must be very old, since the UCC was implemented in 1938… almost 70 years ago. This is a matter of public record. You must be over 95 years old. I congratulate you on longevity of life, but you couldn’t have had a lot of experience at the time. Perhaps you need to lie down and rest for awhile.

One does not have to believe in conspiracy theories to believe that the government has been lying to us. That is a well established fact. The problem is that too many in this country don’t know and don’t care. The “What, me worry” attitude has taken over. Everyone needs to be reminded that George Bush has NEVER killed anyone. It is we the people who do the killing. Until we change, things will continue as they are. The problem is us. Too bad that we can’t impeach the voters who got us into this mess.

The battle for the rights of the people who were forcibly removed from Diego Garcia continues today. I just received a legal update that I have not yet had time to read. It is remarkable that something like that can be happening right now and it is all ignored by the corporate media. It might not be a conspiracy, maybe it is just predatory ignorance of those who control the microphones and the Press.

You are so off I just don’t know where to begin. Yes, I’m a lawyer. I’ve also written a book on early state constitutions. Fifteen years later it’s still selling a few copies. So I know something about different legal systems, including common law and civil law systems.
Contrary to what you said, the common law still applies in every single state in the country except Louisiana, and it’s creeping in there too. It hasn’t gone away.
The UCC is a set of MODEL statutes for COMMERCIAL transactions. It only concerns a limited range of things. The most important parts are article 2 (contracts for the sale of goods) and article 9 (secured commercial transactions). Furthermore, these are only MODEL statutes - recommendations by a panel of law professors. Articles 1 (definitions), 2 and 9 have been adopted in full or in part in every state. Other parts have not been so widely adopted. The UCC is not federal law.
Note that, since the UCC has been adapted in different states at different times, I don’t have to be 95 to have handled pre-UCC cases. As with everything else, you’re wrong about that too.
The joy of the UCC is that I can do business in any state and roughly the same rules apply. It makes life much more predictable. I’m less likely to be cheated because of some obscure local rule I haven’t heard about. The UCC is NOT a Satanic plot by Jews or conservatives or anyone else you may dream up. It isn’t a scheme by the Rothchilds to make money. Contrary to the sources you cited, Lucifer is not involved. It’s just a well thought out set of rules for buying and selling things. One by one, the legislatures in every state have adapted large parts of it because it works.
For God’s sake, do at least a MINIMUM of work before sharing these weird rants with others. How can you POSSIBLY believe that things you’re saying?! I simply can’t understand how someone can be so deluded. Please.

The UCC has nothing to do with criminal law. Nothing. It’s just a set of rules for buing and selling things. That’s all. Buying things and selling things. So everything you said about criminal law and juries is just wrong. Likewise everything you said about admiralty. Just plain wrong.

I’m afraid I’ve read too much information to the contrary to subscribe to your last two comments, #11 (What is your name, anyway?). I’ll send some references for you, and other interested readers to look up. By the way, I’d like to read your book. It sounds like something I would enjoy. What is the name of it, and where can I get it? Also, I never mentioned any names other than those of the Founding Fathers, I never mentioned Satan, I never mentioned the Jews. I’m not quite sure where that came from. As far as I know, and the people who know me, I’m about the least prejudice person I know… and I’m proud of it. Well, we’re not supposed to be proud… I try to be humble about it. I have some of the blood of Judah through my Grandmother, though I do not subscribe to the faith… I’m Christian. I hope that doesn’t offend anyone. I’m a conspiracy fan of the International Banksters. These are the people who profit from the sale of fuel and arms to opposing powers, and do not care about the lives of those on either side. These are people who feel themselves above others. These are the powers which have no loyalty whatsoever except to themselves, and greed for gain and the increase of wealth and power, heedless of method or morals. I do not know their names, but I know they exist. I believe they will keep their names undisseminated as long as they do not have complete power. But when they have set all the pieces in place, which their agents are in the process of right now, they will take up their whips over the slaves, so to speak, and claim complete domination in the name of security and safety. And I do believe this is multi-generational, as the monied family names of today go back in history several generations, though certainly not all, or even most, are involved in what my minds eye contemplates. I still believe the human race to be a compassionate entity on the whole… but one cannot deny facts. I’ll get back with some references for you soon. And thanks for your comments! There is plenty of information for all to read, and it is good, referenced information.To start with… Sorry commentor #11, I meant # 12. #12, and other interested readers, here are some websites to check out about the UCC. Now, as for it all being about commercial stuff, absolutely correct. But that is exactly what ties it in with criminal stuff. You will find out about that at the first listed site above. It explains all about the “compelled benefits” of paying our debts with “federal reserve notes” instead of real money… gold and silver. Tell me, have you ever seen a jury or a court recorder in traffic court? That does not happen as a common rule. (Traffic tickets are considered “civil.") Unless an accident has occured, and in non-moving violations, there are no victims. In these cases, how has a crime occurred, under Common Law, without a victim? And yet we are still fined up the ying yang even though no victim is available to testify against you. The policeman isn’t the victim… he is the one who gave you the ticket. And so we are compelled, by Commercial Law to pay. Extrapolating from that one will find that many of our “criminal” penalties have no victims, and yet under Common Law, victims must exist or there is no crime. Now, to tell the truth, I haven’t studied heavily on the four other websites above, but since it is all academic, they all should compliment each other (or at least not contradict), and there is some good information in all of them. I will be studying them in the next day or so… at least as much of them as I have time to read, so I can converse with a common frame of reference. At best, even if the UCC were not an invention of political puppets for purposes of unseen priorities, the UCC attempts to level an unlevelable playing field. New York and Arizona are too far apart with two different cultures to try and apply all the same rules. The same applies to Florida and Oregon. However, entertaining that kind of rhetoric is just the wallowing in the mire the people who created the UCC intended. Get rid of it, throw it out, get back to Common Law, and back to the Constitution.

The anti-Semitism and Christian fundamentalism weren’t from your own statements, but from Howard Freeman, whom you keep citing with approval. You said to put 1-207 and Howard Freeman in my search engine. I put it in Google and came up with “The UCC Connection” by Howard Freeman, http://www.landrights.com/UCC_1-207.htm.
Section 27 of the article is titled “The Rothschild Influence.” It begins: “When America was founded, the Rothschilds were very unhappy because it was founded on the (Christian) Common Law.” It’s a whole section on how the Rothschilds tried to destroy Christian America so they could make more money. It sounds a lot like the Protocols of the Elders of Zion, doesn’t it? So there’s where I’m coming up with the anti-Semitism. Maybe you haven’t seen this or other anti-Semitic works by Mr. Freeman, but there are several.
I like this quote from section 8: “The bankers said it is not expedient at this time to admit that they own everything and could foreclose on every nation of the world. The reason they don’t want to tell everyone that they own everything is that there are still too many privately owned guns. There are uncooperative armies and other military forces. So until they can gradually consolidate all armies into a WORLD ARMY and all courts into a single WORLD COURT, it is not politic to admit the jurisdiction under which the courts are operating.” Do you find this stuff convincing? This, and everything else Mr. Freeman has to say, is just plain nuts. But if it makes you happy, you keep on reading it.
